What Is a Sublease

A Sublease Agreement is a legal document that permits a tenant to rent the property they are renting to another person.

The original tenant is the sublessor, and the secondary tenant is the sublessee or subtenant

A Sublease Agreement is also known as a:

Receive Permission to Sublease Your Apartment

The first and most important step before creating a Sublease Agreement is to obtain permission from your landlord.

This permission should be in writing and signed by the landlord. 

Collect Information on the Apartment

To then find a sublessee, you will need to put together the following: 

  • Amount of rent you will charge

  • Images of the apartment 

  • Responsibilities such as payment of utilities or cleaning schedules

  • Details about the neighborhood 

List the Property Online

Use a website, such as Craigslist, to post the information and images of the property online. Make sure to include your contact information so anyone interested can contact you. 

Display the Property in Person

Typically, someone interested in re-renting your living space will want to see it firsthand. Organize a time when you and the applicant can meet at the property to show it to them in person

Run a Background Check

It is a good idea to run a background checkon an applicant. Running credit and criminal background checks will ensure you are subleasing your apartment to someone credible. 

Sign the Sublease Agreement

Once you have completed all the steps and found your subtenant, the final step is to sign the Sublease Contract. 

The subtenant will also need to pay the security deposit, first month's rents, and any other necessary fees, such as parking. 

How to Write a Sublease Agreement

When creating your Sublease Agreement, it is essential to include all the necessary information, terms, and conditions.

  4. Add the information of the original lease: Let the subtenant know all the terms of the original lease agreement you made with the landlord. The subtenant must know everything allowed or forbidden on the property. 

  5. Write the rent amount: Include the amount the subtenant must pay monthly. The subtenant must also be aware a failure to pay or any damage done to the property makes you, the original tenant, responsible.
