What Is a Release of Liability Form

A Release of Liability Form is a document that protects a party against future legal claims that could be made in case of an accident, damages, or loss of money. 

A Release of Liability Form includes 2 parties. 

  • Releasor: This is the party that is releasing the other party.  

  • Releasee: This is the party that is released from any legal accountability

This form is typically given to someone by an organization or company.

It can also be given to someone after an accident or written by someone who owes a debt. 

Under these circumstances, the releasee might pay the releasor. 

A Release of Liability Form goes by different names, including:

Release Form by Type

A Release of Liability Form is useful for preventing lawsuits. For particular cases, you must use a specific Release of Liability Form.

  • Effective date: The date the waiver takes effect

How to Write a Release of Liability Form

  1. Fill in the information of both parties, including each person’s name and address. 

  2. Include the details of the event. This means, describing the event that took place that led to the dispute and the releasee’s actions. This contains a statement that no further legal action will be taken against these actions. 

  3. Add if there is a payment required by the releasee. Include the amount that needs to be paid if there will be a payment

  4. Write a section for signatures, which will contain the names and dates of both parties.

Due to my participation in the activity of _________ organized by _________, of _________, and/or use of the property, facilities and services of _________, I and (if applicable) my family members agree to the following:
A) AGREEMENT TO FOLLOW INSTRUCTIONS

For the proper development of the activity, I agree to heed and pay attention to all posted rules, and further agree to follow any oral directions and warnings given by _________, or the staff of _________.
B) ASSUMPTION OF THE RISKS AND RELEASE

My choice to participate in the activity is knowing, voluntary, and made for my enjoyment. E) NO DURESS

I have been given a reasonable opportunity to review this Agreement before signing. I agree and acknowledge that I am not under any pressure or duress to sign it. I further agree that I am free to have my legal counsel review this Agreement if I choose to. I also agree and acknowledge that _________ has offered to refund any expenses I have paid to use its facilities if I finally decide not to sign this Agreement.
F) APPLICABLE LAW

If any legal or equitable claim arises from my participation in the above mentioned activity, it will be resolved under _________ law.
G) ENFORCEABILITY

This Release of Liability shall be binding upon and enforceable against me, my representatives, spouse, assigns, heirs, and next of kin without limitation. It is my desire and intent that the words, terms, provisions, covenants, and remedies contained in this Agreement shall be enforceable to the fullest extent permitted by Applicable Law. If any portion of this Agreement and is held invalid, the remainder shall not be affected and shall continue in full legal force and effect.
