Georgia's in-state, private gun sale laws are relaxed. You may list a firearm for sale online, provided you follow State rules during the transfer.
You may sell a gun in Georgia in several ways.
Private gun sales in Georgia
Private firearm transfers in Georgia are subject to both Georgia and federal law.
Federal law generally allows an unlicensed person to transfer a firearm to another same-state resident who is at least 18.
You cannot knowingly sell to a prohibited person, such as a felon. Some private sellers may feel more comfortable dealing with a buyer who holds a Georgia Weapons Carry License (WCL). The seller should still avoid any transfer they know or suspect would be unlawful.
Verify that the buyer is a Georgia resident by checking their driver's license. When done, write a Georgia Firearm Bill of Sale Form to finalize the transfer.
Selling to a licensed dealer
You may choose to sell to a:
- Gun shop
- Pawn shop
- Licensed firearms distributor
This option is always safer because the dealer can easily perform a background check on the next buyer.
Licensed dealers must conduct instant background checks on buyers. Their FFLs allow them to access the National Instant Criminal Background Check System (NICS).
